Subdivisions

Nicholas County Health Department permits land subdivisions for the purposes of ensuring proper sewage disposal according to W.Va. 64 C.S.R. 9.  Subdivisions are a tract of land which has been divided into two or more lots, tracts, parcels, plats, sites, areas, units, interests or other division for the purposes of dwelling or establishment development and including the division of land by deed, metes and bounds description, lease, map, plat or other instrument, or by the act of construction.  Subdivisions served by public sewage disposal or for commercial purposes are exempt from Nicholas County Health Department permitting.

Required subdivision permits are issued following the submission of a Subdivision Approval Application Form and payment of required fees, provided that all lots are approved for proper onsite sewage disposal.

Lots or land divisions of permitted subdivisions require ten thousand square feet segregated for the sole purpose of onsite sewage disposal.
